1. Who we are
NusaBook ("NusaBook", "we", "us") is operated as a sole-proprietor software service. Our address and contact details are available on request at hello@nusabook.com.
2. What you agree to
By signing up for NusaBook, connecting a WhatsApp number, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You confirm you are at least 18 years old and authorised to enter into this agreement on behalf of the business you are registering.
3. The Service in plain English
NusaBook provides:
- A dashboard for tourism businesses ("Operators") to manage bookings, customers, services, hours, and conversations.
- An AI assistant that replies to your customers on WhatsApp on your behalf and creates bookings when customers confirm.
- Optional integrations (Google Maps booking link, Twilio WhatsApp Business API).
NusaBook is a booking facilitation tool. We do not take payment from your customers for your services. We do not become a party to the transaction between you and your customer. Refunds, cancellations, and service quality are your responsibility.
4. Your account
You are responsible for keeping your sign-in credentials confidential and for all activity under your account. Tell us immediately at hello@nusabook.com if you believe your account has been accessed without permission.
Each NusaBook account belongs to one business (one tenant). Do not share the account across separate businesses.
5. Acceptable use
You agree NOT to use NusaBook to:
- Send spam, unsolicited marketing, or messages that violate WhatsApp's Business Policy or Terms of Service.
- Impersonate another business or individual.
- Sell illegal goods or services, or services prohibited by your local jurisdiction.
- Process customer data on behalf of someone other than the registered business.
- Probe, scan, reverse-engineer, or attempt to bypass platform security.
- Resell or sublicense the Service without our written agreement.
We may suspend or terminate accounts that violate these rules, with or without notice depending on severity. Egregious violations (illegal content, attempts to defraud customers) result in immediate termination.
6. Subscription and billing
Paid plans are billed monthly in advance, in US dollars, through Stripe. By starting a subscription you authorise NusaBook to charge your selected payment method on the same calendar day each month.
New accounts receive a 14-day free trial. You will not be charged during the trial. If you cancel before the trial ends, you are not charged.
You may cancel at any time from the dashboard's Billing page. Your access continues until the end of the current paid period; we do not prorate refunds for partial months.
Some operators incur pass-through fees from third-party providers (e.g. Twilio for WhatsApp Business API). These fees are billed separately by the third party and are not part of your NusaBook subscription.
We may change pricing for future billing periods with 30 days' notice emailed to your account address. Continued use after the price change constitutes acceptance.
7. Your data, your customers' data
You retain ownership of all data you upload, type, or generate using NusaBook (services, hours, business description, bookings, customer records, conversation logs). We hold that data on your behalf and process it only to operate the Service. See our Privacy Policy and Data Processing Agreement for the details.
You are the data controller for your customers' personal data (names, phone numbers, message content). You are responsible for having a lawful basis to process that data and for telling your customers how it's handled.
8. AI replies
The AI assistant produces replies based on the business profile, services, hours, and conversation history you have provided. We make reasonable efforts to keep it accurate but the AI can make mistakes. You are responsible for reviewing automated replies and bookings, especially during the first weeks of use. NusaBook is not liable for losses arising from AI errors that a reasonable human review would have caught.
9. Availability
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance, third-party outages (Vercel, Supabase, Twilio, Anthropic, Meta/WhatsApp), and force-majeure events may interrupt access. We do not credit or refund for downtime.
10. Liability cap
To the maximum extent permitted by law, NusaBook's total liability to you in connection with the Service is capped at the amount you paid NusaBook in the twelve months before the event giving rise to the claim. We are not liable for lost profits, lost bookings, or consequential damages.
Nothing in these Terms limits liability for gross negligence, wilful misconduct, or anything that cannot be limited by law.
11. Termination
Either side may end the agreement at any time. You can delete your account from the dashboard. We may suspend or terminate accounts that violate these Terms, abuse the Service, or for other legitimate business reasons after reasonable notice (immediate for severe breaches).
On termination, we delete your data within 90 days unless retention is required by law. You may export your data before then via the export tool in the dashboard.
12. Changes to these Terms
We may update these Terms. Material changes will be emailed to your account address and announced in the dashboard at least 30 days in advance. The "Last updated" date at the top of this page changes whenever the text does.
13. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which NusaBook is operated. Disputes are first attempted in good-faith negotiation by email; if unresolved within 30 days, either side may bring a claim in the courts of that jurisdiction.
